SafeguardKit

Terms, Disclaimer & License

Current as of October 2026. This is the disclaimer and license from the Read-Me-First file included in every SafeguardKit template pack. The Read-Me-First file in the kit you buy is the version that applies to that kit.

The short version, in plain English

  • These are templates, not legal advice. We are not your lawyer or consultant.
  • Using them does not guarantee compliance or that you will pass any audit or exam. What counts is how you fill them in and actually run your security program.
  • You must customize the documents, put them into practice, and check them against current law. Rules may change after October 2026.
  • If something goes wrong, our liability is limited to what you paid for the pack.
  • One business may use them internally. Please do not resell or share them.

These terms are an agreement between you (the buyer and the business you buy for, "you") and SafeguardKit ("SafeguardKit," "we," "us"). By downloading, opening, or using any file in a SafeguardKit pack (the "Templates"), you agree to these terms. If you do not agree, do not use the Templates.

Disclaimer

  1. Not legal or professional advice. The Templates are general information, not advice for your situation. They are not legal, tax, accounting, or information-security advice. Buying or using them does not create an attorney-client, consultant-client, fiduciary, or any other professional relationship between you and SafeguardKit. You should have your completed plan reviewed by a qualified attorney and/or information security professional, especially for state-law obligations (breach notification, data security, record retention) and contract language. Some editions list related obligations (for example, privacy notices, the Red Flags Rule, Form 8300, Regulation F, Regulation S-P, AML, HIPAA, or PCI DSS); those are separate obligations that the Templates list but do not replace.
  2. No guarantee of compliance or audit results. Using the Templates does not by itself make your business compliant with the FTC Safeguards Rule (16 CFR Part 314), IRS requirements, any other federal or state law, or any regulator, lender, or industry standard. SafeguardKit makes no representation or guarantee that use of the Templates will result in regulatory compliance, or that your business will pass any audit, examination, inspection, investigation, or review by any government agency, insurer, client, or other party. Compliance depends on what your business actually does: running the safeguards, training staff, overseeing vendors, and keeping the plan current.
  3. You are responsible for your plan. You are solely responsible for customizing every section to your business's size, systems, data, and risks; for implementing and maintaining the safeguards you describe; and for verifying that the finished documents are accurate, complete, and consistent with the laws, regulations, and guidance that apply to you at the time you use them.
  4. Current as of October 2026; rules change. The content reflects the sources listed in the References document as they stood in October 2026 (the publication date of this version). Laws, regulations, IRS publications, and agency guidance may change after that date. SafeguardKit has no obligation to update the Templates or to notify you of changes. Always check the current version of every law and publication.
  5. No affiliation. SafeguardKit is not affiliated with, endorsed by, or sponsored by the IRS, the FTC, the Security Summit, or any government agency, industry association, or software vendor named in the Templates. IRS Publication 5708 is a free government publication; the tax-preparer pack is an independent adaptation and expansion.

Warranty, Liability, and Indemnity

  1. Provided "as is"; no warranties. We do our best to make the Templates accurate and useful, but we cannot promise they are error-free or right for your business. THE TEMPLATES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEGUARDKIT DISCLAIMS ALL WARRANTIES, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND COMPLETENESS.
  2. Limitation of liability. If something goes wrong, the most we will owe you is what you paid for the pack. TO THE FULLEST EXTENT PERMITTED BY LAW, SAFEGUARDKIT WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, OR ANY FINES, PENALTIES, SECURITY INCIDENTS, OR THIRD-PARTY CLAIMS, ARISING OUT OF OR RELATED TO THE TEMPLATES OR THEIR USE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SAFEGUARDKIT'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE TEMPLATES, UNDER ANY THEORY (CONTRACT, TORT, NEGLIGENCE, OR OTHERWISE), WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT. Some jurisdictions do not allow certain exclusions or limits, so some of the above may not apply to you; in that case our liability is limited to the smallest amount the law allows.
  3. Indemnification. You are responsible for how you use the Templates. To the extent permitted by law, you agree to indemnify, defend, and hold harmless SafeguardKit and its owners, employees, and contractors from and against any claims, losses, liabilities, damages, fines, penalties, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Templates, your security program, or your breach of these terms.

License

  1. Single-business license. Your purchase grants you a limited, non-exclusive, non-transferable license for one business (one legal entity, including its own owners, staff, and locations) to edit, print, and use the Templates for that business's internal purposes.
  2. No resale or redistribution. You may not resell, sublicense, redistribute, share, publish, or give away the Templates, in original or edited form, as templates or as part of any product or service, and you may not upload them to template, file-sharing, or marketplace sites. Your finished, filled-in plan is yours to use within your business. Consultants or firms serving multiple businesses need a separate license: contact us through the SafeguardKit shop on Etsy.
  3. Ownership. SafeguardKit keeps all rights, title, and interest in the Templates. The license ends automatically if you break these terms. © 2026 SafeguardKit. All rights reserved.

General

  1. Governing law. These terms are governed by the laws of the State of North Carolina, USA, without regard to its conflict-of-law rules.
  2. Severability; nothing else limits your legal rights. If any part of these terms is found unenforceable, it will be enforced to the maximum extent permitted and the rest remains in effect. Nothing in these terms limits any right you have that cannot be limited or waived under applicable law.
